1. Parties

This Safety & Liability Waiver (“Waiver”) is entered into between the undersigned participant (or parent/guardian of a minor participant) (“Participant”) and Hamilton Cricket Association (HCA Canada), its directors, officers, employees, coaches, volunteers, agents, sponsors, and venue partners (collectively “HCA”).

2. Assumption of Risk

Participant acknowledges that sports and recreational activities organized by HCA — including but not limited to cricket (leather ball, hard tennis, tape ball), badminton, squash, pickleball, soccer, basketball, baseball, training sessions, tournaments, and special events — involve inherent risks of physical injury, illness, disability, or death, as well as risk of damage to or loss of personal property. These risks include, without limitation: collisions, falls, struck-by-ball or equipment incidents, slips, overexertion, weather-related conditions, and facility-related hazards at indoor domes, arenas, gyms, fields, or any other venue used by HCA.

Participant voluntarily assumes all such risks, both known and unknown, whether or not caused in whole or in part by the negligence of HCA.

3. Release of Liability

In consideration of being permitted to participate in any HCA program, event, or activity, Participant hereby releases, waives, discharges, and covenants not to sue HCA from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, injury (including death), or property damage that may be sustained by Participant while participating in, traveling to/from, or present at any HCA activity or venue.

This release includes claims arising from the ordinary negligence of HCA. It does not release claims arising from gross negligence, willful misconduct, or intentional acts of HCA.

4. Property & Equipment

HCA is not responsible for any loss, theft, or damage to personal property, equipment, vehicles, or belongings of any kind that occurs at any HCA event, practice, tournament, or venue (including Ancaster Sports Centre Dome, Saltfleet Arena, LA Fitness, outdoor grounds, or any other facility used by HCA). Participants are solely responsible for securing their own belongings.

5. Medical Condition & Fitness

Participant represents that they are physically fit and have no medical condition that would prevent safe participation. Participant agrees to immediately notify HCA staff of any injury, illness, or condition that arises during an activity. HCA may, at its discretion, refuse participation if a Participant appears unfit or poses a risk to themselves or others.

6. Minors

If the Participant is under 18 years of age, a parent or legal guardian must agree to this Waiver on the minor’s behalf. The parent/guardian accepts full responsibility for the minor and agrees to the same terms of release and assumption of risk.

7. Photo / Media Release

Participant grants HCA permission to use photographs, video, or other media taken during HCA activities for promotional, website, social media, and archival purposes without compensation.

8. Governing Law

This Waiver shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising under this Waiver shall be resolved in the courts of Ontario.
